Brominated vegetable oil, or BVO, spent decades as a common stabilizer in citrus-flavored sodas and sports drinks before being formally banned from the U.S. food supply in 2024. The controversy behind it comes down to a long, uneven history of regulatory caution, mounting evidence of harm, and a decades-long gap between when scientists first raised concerns and when regulators finally acted. Here’s what actually put BVO on the wrong side of food safety debates.
What BVO Actually Is and Why It Was Used
BVO is a vegetable oil chemically modified with bromine, an element that also shows up in flame retardants. Combining bromine with vegetable oil makes the oil denser, which lets it act as an emulsifier — keeping citrus flavoring evenly distributed throughout a drink instead of separating and floating to the top. For roughly 50 years, this made BVO a go-to stabilizer in fruit-flavored sodas, sports drinks, and energy drinks, including well-known brands like Gatorade and Mountain Dew before they reformulated.
A Long History of Regulatory Doubt
BVO’s controversy didn’t start recently — it stretches back over half a century. The ingredient was originally on the FDA’s “Generally Recognized as Safe” list in the 1950s, but that status didn’t last. Following toxicity studies conducted by Canadian food regulators in 1969, the FDA pulled BVO from the GRAS list in 1970 and instead allowed it only under an “interim” status as a flavoring stabilizer, capped at low concentrations of 15 parts per million or less. That interim classification — essentially a regulatory holding pattern — persisted for more than 50 years, even as international regulators moved faster: the UK banned BVO outright in 1970, and the European Union followed in 2008.
The Science That Tipped the Scale
What ultimately pushed the FDA toward a full ban was a body of research linking BVO to genuine health risks. A study in pigs found that consumption damaged their hearts, kidneys, livers, and testicles, while broader research has tied the ingredient to nervous system damage, headaches, fatigue, and loss of muscle coordination and memory. The more decisive evidence came from a 2022 study in rats, which found that BVO’s breakdown products accumulated in the heart, liver, and fat tissue, and that high doses caused enlargement of thyroid cells — a finding with implications for a gland that plays a central role in regulating metabolism, heart rate, and blood pressure. The FDA cited that thyroid research directly in its decision, stating that available data “no longer provide a basis to conclude the use of BVO in food is safe.”
States Moved Faster Than Federal Regulators
Part of what makes BVO’s story controversial is the sequence of events. California banned BVO at the state level in October 2023, becoming the first state to outlaw a food chemical still technically permitted by the FDA — a move that put pressure on federal regulators and highlighted how far behind U.S. policy had fallen compared to international standards. The FDA didn’t formally revoke its regulation allowing BVO until July 2024, with enforcement of the ban not beginning until August 2025 to give manufacturers time to reformulate.
Why It Took So Long to Ban
Consumer advocacy groups have been particularly vocal about the gap between known risk and regulatory action. The Environmental Working Group noted that the FDA had been aware of BVO’s potential harm for decades before finally acting, while Consumer Reports pointed to the ingredient’s documented links to thyroid, heart, liver, and neurological problems as evidence the ban was overdue rather than precautionary. That criticism reflects a broader tension in U.S. food additive regulation: an “interim” safety classification from 1970 effectively allowed continued use for over 50 years without the ingredient ever regaining full approval, a regulatory gray area that many public health advocates saw as unacceptably slow.
Where BVO Stands Today
Most major beverage brands, including Coca-Cola and PepsiCo, phased BVO out of their products well before the federal ban took effect. Even so, some smaller and regional brands — including certain formulations of Sun Drop, along with some store-brand orange sodas — continued using BVO closer to the enforcement deadline. Products manufactured before the August 2025 compliance date could still technically contain trace amounts, though any beverage produced after that point should be BVO-free under current FDA rules.
